1.1. Easy Photo Book, based in the Netherlands, operates the website easyphotobook.me (the “Website”) and provides services that allow users to create and print personalized photo books (the “Services”). By accessing or using the Website or the Services, the User agrees to these Terms & Conditions.
1.2. These Terms & Conditions, together with the Privacy Policy, govern the User’s access to and use of the Website and the Services. The User is advised to review them carefully before placing an order.
1.3. Definitions. For the purposes of these Terms:
2.1. To use the Services, the User may be required to authorize access to User Content (e.g., images) to create a Photo Book. By uploading or providing User Content, the User represents and warrants that the User owns the User Content or has all necessary rights, permissions, and consents to use and provide it for the purposes of these Terms (including, where applicable, rights related to third parties’ personal data, publicity rights, and intellectual property rights).
2.2. Use of the Website to create a Photo Book may be free of charge; however, fees apply if the User purchases a printed Photo Book. Payments are processed via Stripe (or another payment provider made available on the Website).
2.3. The User must not upload User Content that infringes third‑party rights or violates applicable laws. Easy Photo Book may remove User Content, suspend access, or terminate accounts where infringement is suspected or confirmed. If an order is affected by such a situation, Easy Photo Book may cancel the order where necessary. Any refunds (if applicable) will be provided only as required by applicable law and/or to the extent Easy Photo Book has not incurred irreversible production costs.
2.4. User Content is processed and stored on Easy Photo Book’s systems and shared with printing and logistics partners only as necessary to produce and deliver the Photo Book. Easy Photo Book does not use User Content for advertising or marketing purposes without the User’s consent. If Easy Photo Book uses any data to improve the Services, this will be done as described in the Privacy Policy and, where required, based on the User’s consent.
2.5. The User retains ownership of User Content. The User grants Easy Photo Book a limited, non‑exclusive license to process, reproduce, and transmit User Content solely to provide the Services (including printing and delivery of the Photo Book).
2.6. Easy Photo Book may modify, limit, or discontinue parts of the Services. Where reasonably possible, Easy Photo Book will provide notice of material changes, except where immediate action is required for security, legal, or operational reasons.
3.1. The User can create a Photo Book using User Content from the User’s devices, social media accounts, or other sources. Layouts may be generated automatically. The User is responsible for selecting the User Content and reviewing the final preview before placing an order (including spelling, image quality, cropping, and layout).
3.2. The User is solely responsible for ensuring that User Content is lawful and does not violate third‑party rights. The User agrees to indemnify Easy Photo Book as set out in Section 7.
3.3. Manufacturing is managed by print‑on‑demand partners. Easy Photo Book and/or its partners may place identifying marks (e.g., a logo, barcode, or unique production number) on or in the Photo Book for production, quality control, or operational purposes.
3.4. After the Photo Book is created, the User may order one or more printed copies for personal or commercial use. Photo Books will be printed, bound, and shipped to the shipping address provided by the User.
3.5.The User may distribute and sell the User’s printed Photo Books.
3.6. Prices and shipping costs are displayed at checkout. Price changes do not affect orders that have already been confirmed.
3.7. After an order is placed, the User will receive an order confirmation email. A binding contract for the printed Photo Book is formed only when Easy Photo Book confirms the order.
4.1. Payment for printed Photo Books is due at the time of order via the available payment methods. Prices may include applicable taxes shown at checkout. For international shipments, import duties, customs fees, or local taxes (if any) may be payable by the User upon delivery, depending on the destination country’s rules.
4.2. Photo Books are made to the User’s specifications and are clearly personalized. For this reason, orders typically cannot be canceled or modified once placed and confirmed. This clause does not affect any mandatory rights the User may have under applicable consumer protection laws (including EU rules on personalized goods).
4.3. In case of a verified printing or manufacturing defect, Easy Photo Book may offer a reprint at no additional cost. The User may be asked to provide reasonable documentation (e.g., photos) of the defect. Shipping delays alone do not qualify as printing defects.
4.4. Delivery times are estimates and may vary, especially during peak periods. Easy Photo Book does not guarantee specific delivery dates.
4.5. Shipping Information and Undeliverable Orders.The User is responsible for ensuring that the shipping address provided at checkout is complete and accurate. Orders are shipped strictly to the address entered by the User. If a delivery cannot be completed due to an incorrect or incomplete shipping address, the courier service may be unable to return or redirect the order. As Photo Books contain personal images and private data, undeliverable orders may be handled in accordance with strict data protection and privacy requirements and may be securely destroyed by the courier. In such cases, the original order cannot be delivered or resent. To receive the Photo Book, a new order must be placed with the correct shipping details.
4.6. Lost or Damaged Shipments (Before Delivery).If a shipment is lost or arrives damaged before delivery is completed (excluding cases related to an incorrect or incomplete shipping address), the User should contact Easy Photo Book support within 30 days from the purchase. Easy Photo Book will investigate and, where appropriate and as required by applicable law, may offer a reprint or another suitable solution.
5.1. By using the Services, the User grants Easy Photo Book a non‑exclusive, worldwide license to process, format, and transmit User Content solely for providing the Services (including production and delivery of the Photo Book).
5.2. The User may stop using the Services at any time. However, User Content already submitted for production of an order cannot be withdrawn from that production process once manufacturing has started.
6.1. The User agrees to provide accurate and complete information when using the Services and to keep such information up to date.
6.2. The User is responsible for maintaining the confidentiality of login credentials and for all activities performed under the User’s account.
6.3. The User must not misuse the Services, including attempting to interfere with the Services’ security or functionality or uploading malicious software.
6.4. The User must not duplicate, sell, or commercially exploit any portion of the Services without prior written permission from Easy Photo Book, except in relation to the sale or distribution of the User’s own printed Photo Books.
7.1. The User is solely responsible for User Content and for any consequences arising from its use. The User agrees to indemnify and hold harmless Easy Photo Book from claims arising from User Content uploaded, shared, or distributed through the Services.
7.2. Easy Photo Book may review, block, or remove User Content that violates these Terms or applicable law.
7.3. To the maximum extent permitted by applicable law, Easy Photo Book is not liable for indirect or consequential damages. Nothing in these Terms limits liability where such limitation is not permitted by law.
8.1. These Terms are governed by the laws of the Netherlands, without prejudice to mandatory consumer protection laws that may apply based on the User’s place of residence.
8.2. If the User is a consumer residing in the EU/EEA, mandatory EU rules on consumer jurisdiction may allow the User to bring proceedings in the courts of the User’s country of residence. For other Users and to the extent permitted by applicable law, disputes shall be brought before the competent courts in the Netherlands.
8.3. Easy Photo Book encourages resolving disputes amicably. The User may contact support to seek a solution before initiating legal action.
9.1. Easy Photo Book may update these Terms from time to time. Changes take effect prospectively. If changes are material, Easy Photo Book will provide notice via the Website and/or email where reasonably possible.
9.2. Continued use of the Services after the effective date of updated Terms constitutes acceptance of the updated Terms.
